The stay order effectively halts the implementation of the government’s exemption policy until the court reaches a final verdict on the matter. This comes as a significant relief to MPJ and advocates for equal access to education, who argued that the government’s policy would exacerbate existing inequalities in the education system.

The Right to Education Act, a central government legislation, mandates that private schools reserve 25% of their seats for children from economically disadvantaged backgrounds (EWS) and socially disadvantaged groups (SDG). The Maharashtra government’s exemption policy had sparked outrage among activists who argued that it diluted the act’s objective of promoting inclusive education.

“This is a landmark decision that upholds the fundamental right to education for all children,” said Muhammad Siraj MPJ’s President. “We are hopeful that the court will ultimately rule in our favour and ensure that all children, regardless of their background, have access to inclusive and quality education.”

The Maharashtra government had previously defended its decision. However, critics argued that the policy would create a two-tiered education system, with underprivileged children relegated to government schools while wealthier families have access to better-resourced private institutions.

The MPJ’s petition argued that the government’s exemption policy undermined the RTE’s goals and exacerbated social segregation in the education system. The High Court’s stay order upholds this argument, at least for the interim, and paves the way for a more equitable implementation of the RTE in Maharashtra.

The amendment, known as the “Maharashtra Right of Children to Free and Compulsory Education (Amendment) Rules, 2024”, introduces a provision exempting private schools situated within a 1km radius of government or aided schools from allocating 25% of their seats to underprivileged and weaker section children under the RTE quota.

MPJ vehemently opposes this amendment, asserting that it undermines the fundamental tenets of the RTE Act and exacerbates existing educational disparities. Muhammad Siraj, State President of MPJ, stated, “The RTE Act stands as a pivotal piece of social justice legislation. The exemption of private schools from the mandated 25% reservation undermines this fundamental principle, perpetuating a segregated educational system that obstructs inclusivity.”

Siraj further emphasised that the amendment imposes arbitrary geographical constraints, depriving disadvantaged children of access to potentially superior educational opportunities, regardless of their specific needs. Moreover, this measure widens the educational chasm between privileged and underprivileged communities by impeding access to higher-quality private schools.

Shabbir Deshmukh, the MPJ’s spokesperson and one of the petitioners said that the exemption of private schools is likely to discourage their participation in the program, thereby diminishing the overall number of available seats for disadvantaged and weaker section children. Furthermore, this amendment establishes a troubling precedent by potentially superseding central legislation such as the RTE Act.

In response to the gazette notification, MPJ organized protests across the state, urging the withdrawal of the contentious amendment. Regrettably, the state government unheeded these appeals from civil society and proceeded with the process of soliciting online applications from parents for RTE 25% admissions for the academic year 2024-2025. The deadline for submission of online applications by parents is April 30, 2024, he added.

Deshmukh said that consequently, the sole recourse remaining was to challenge the amendment in the high court. The Bombay High Court has admitted the writ petition filed by MPJ, with a hearing scheduled for April 29, 2024. Siraj expressed optimism, stating, “We trust that the court will recognize the adverse ramifications of this amendment and safeguard access to quality education for all children in Maharashtra.” The petitioners are being represented in court by the senior advocate, Gayatri Singh and Shreya Mohapatra.

ग़ौर तलब है कि राज्य के स्कूल शिक्षा विभाग ने बीते 9 फरवरी को एक गजट अधिसूचना जारी की जिसमें कहा गया कि अब महाराष्ट्र में सरकारी स्कूल या सरकारी सहायता प्राप्त स्कूलों के एक किमी दायरे में आने वाले प्राइवेट स्कूल नि:शुल्क और अनिवार्य बाल शिक्षा अधिकार नियम, 2013 के तहत वंचित समूह और कमजोर वर्ग के लिए 25 प्रतिशत आरक्षित सीटों पर एडमिशन के लिए बाध्य नहीं होंगे। इस संशोधन के तहत, सरकारी स्कूल या सरकारी सहायता प्राप्त स्कूल के एक किलोमीटर के दायरे में स्थित निजी स्कूलों को आरटीई के तहत 25% सीटें आरक्षित करने की आवश्यकता नहीं होगी। एमपीजे ने इस संशोधन को “गरीब विरोधी” और “शिक्षा के अधिकार का हनन” करार दिया।

एमपीजे के प्रदेश अध्यक्ष मुहम्मद सिराज ने मीडिया से बात करते हुए कहा कि यह संशोधन  शिक्षा का अधिकार अधिनियम 2009 के मूल उद्देश्यों को कमजोर करता है। यह संशोधन शिक्षा में असमानता को बढ़ाएगा और गरीब बच्चों को गुणवत्तापूर्ण शिक्षा से वंचित करेगा। इस नए नियम की वजह से प्राइवेट स्कूलों में 25% कोटे की सीट्स में बड़े पैमाने पर कमी हो जाएगी, जिसकी वजह से ग़रीबों के बच्चों को क्वालिटी शिक्षा हासिल करने का क़ानून द्वारा दिए गए हक़ से महरूम होना पड़ेगा। सिराज ने सरकार की निजी हितों को वंचित और आर्थिक रूप से कमज़ोर समुदायों के कल्याण पर प्राथमिकता देने की आलोचना की और फैसले को तत्काल वापस लेने का आह्वान किया।

उन्होंने कहा कि प्रदेश सरकार इस संशोधन के द्वारा सरकारी स्कूलों में शिक्षा की गुणवत्ता और बुनियादी ढांचे में सुधार की दिशा में काम किए बिना वंचित और कमज़ोर वर्ग के बच्चों को सरकारी स्कूलों में एडमिशन लेने को मजबूर कर रही है। हम महाराष्ट्र शासन से मांग करते हैं कि वे इस संशोधन को तुरंत वापस लें और शिक्षा का अधिकार अधिनियम के मूल उद्देश्यों को लागू करने के लिए प्रतिबद्धता ज़ाहिर करें।

पूर्व सांसद भाल चंद्र मुंगेकर भी आज यहां एमपीजे के धरने में शामिल हुए। उन्होंने कहा कि जब यह शिक्षा का अधिकार कानून बन रहा था, तब मैं योजना आयोग की शिक्षा समिति का सदस्य था। 25% आरक्षण का उद्देश्य सभी के लिए समान और समावेशी शिक्षा का अवसर प्रदान करना था। महाराष्ट्र सरकार ने अध्यादेश में संशोधन कर लोगों के अधिकारों का हनन किया है. जनहित में यह संशोधन यथाशीघ्र वापस किया जाना चाहिए।

प्रदर्शनकारियों ने डिस्ट्रिक्ट मजिस्ट्रेट के माध्यम से मुख्यमंत्री को एक ज्ञापन सौंपा, जिसमें इस संशोधन को तुरंत वापस लेने की मांग की गई।

प्रदर्शन में शामिल विभिन्न सामाजिक संगठनों ने भी सरकार से इस संशोधन को वापस लेने की मांग की। उन्होंने कहा कि “यह संशोधन लाखों गरीब बच्चों को शिक्षा के अधिकार से वंचित करेगा। इस से शिक्षा में असमानता को बढ़ावा मिलेगा और गरीब बच्चों को शिक्षा प्राप्त करने से वंचित करेगा। सरकार को इस फैसले पर तुरंत पुनर्विचार करना चाहिए और आरटीई में किए गए संशोधन को वापस लेना चाहिए”।

The convention was organised on the theme “A Step Towards Inclusive Development” in Jalgaon today. The convention aimed to spotlight the imperative of inclusive development in the nation, ensuring the involvement of all societal segments in the developmental trajectory.

Mahmood Khan, the Vice President of MPJ, underscored the prevalent disparity in the country, highlighting instances where citizens were compelled to drink water from shoes. He emphasized the enduring quest for equality and lamented the pervasive social and economic inequalities. Khan reiterated MPJ’s commitment to advocating for comprehensive development.

Elaborating on MPJ’s vision, the organisation’s Vice-President stressed the constitutional assurance of every citizen’s dignity. Quoting Pandit Jawaharlal Nehru and Baba Saheb, he underscored the ongoing struggle for social democracy post-independence, stressing the imperative of inclusive development. He said that addressing the nation after the country’s independence, Pandit Jawaharlal Nehru said that though we have got freedom today, our freedom struggle will continue till we wipe the tears from the eyes of the last person in the line.

In his address, Muhammad Siraj, the President of MPJ Maharashtra, acknowledged the strides in development but lamented the uneven distribution of its benefits. He delineated prevailing challenges like hunger, disease, malnutrition, and unemployment, affirming MPJ’s mission to establish peace and justice amidst escalating socioeconomic disparities.

Mohammad Ilias Falhi, President of Jamaat-e-Islami Hind Maharashtra, urged greater accountability among leaders to ensure justice for all. He lamented the transformation of India from a welfare state to a corporate welfare state, advocating for heightened public scrutiny of leadership.

Eminent economist Professor Arun Kumar cautioned against the burgeoning black economy, attributing its adverse effects on society to dwindling employment opportunities, particularly in the agriculture and banking sectors. He highlighted staggering statistics of job seekers and underscored the need for concerted efforts towards economic justice.

Addressing women’s issues, activist Yogini Khanolkar decried the government’s land acquisition policies, exacerbating women’s vulnerabilities and compromising their dignity. She called for policy interventions and ensured places for women in the policy formulation process to safeguard women’s rights amidst escalating challenges.

Farmer leader Vijay Jawandhiya castigated governmental neglect of farmers’ grievances, accusing successive administrations of favouring corporate interests over agricultural welfare. He urged a return to socialist principles, decrying the politicization of religion to deflect attention from systemic issues.

Renowned activist Pratibha Shinde expressed dismay over the neglect of indigenous communities, urging for concerted efforts to address their plight and combat societal marginalization.

In his closing remarks, Salim Engineer, the National Vice-President of Jamaat-e-Islami Hind, decried the rise of divisive nationalist sentiments and underscored the imperative of upholding constitutional principles of equality, justice, freedom, and fraternity for national cohesion and progress.

The convention concluded with a resounding call for collective action towards inclusive development, underlining the urgency of addressing societal inequities and fostering unity amidst diversity.

एमपीजे महाराष्ट्र का संविधान दिवस पर मुंबई से चला बंधुता कारवां नांदेड़ पहुंचा। कारवां ने नुक्कड़ सभाएं, स्ट्रीट प्लेज़ और सांस्कृतिक कार्यक्रमों का आयोजन किया। इन कार्यक्रमों के माध्यम से लोगों को प्रेम, आपसी सहयोग, अमन, न्याय, और बंधुता का संदेश दिया।

शहर के रेडियंट इंस्टिट्यूट में एक इंटेलेक्चुअल चर्चा सत्र का भी आयोजन किया गया। इस चर्चा सत्र की अध्यक्षता कोंपलवार सर ने की और इसमें जिले के विभिन्न सामाजिक संगठनों के पदाधिकारीगण शामिल हुए।

People praise MPJ’s
initiative to safeguard individual dignity

On November 27, 2023, a
Bandhuta Caravan carrying a message of love, compassion, and brotherhood
embarked on a journey across various districts of the state. The caravan’s
first stop was Jalana, where it spread its message of unity, integrity, and
dignity of individuals through lectures and cultural programs held in schools
and public spaces. The Bandhuta
Caravan is part of MPJ’s larger fraternity campaign, which is running from
November 26, 2023, to December 10, 2023. The campaign aims to promote the
constitutional values of fraternity, ensuring individual dignity and national
unity.

महाराष्ट्र में कुपोषण और एनीमिया की स्थिति गंभीर बनी हुई है. सरकार ने लोगों
की पोषण और स्वास्थ्य समस्याओं को हल करने के लिए उनके मुहल्ले में ही ICDS के तहत आंगनवाड़ी केंद्र की व्यवस्था की
है, जहाँ महिलाओं और बच्चों को आवश्यक पोषण, स्वास्थ्य, और प्रारंभिक शिक्षा सेवाएं मिलती हैं. लेकिन आम जन को अपने
पड़ोस में चल रहे आंगनवाड़ी के बारे में उचित जानकारी नहीं होने की वजह से लाभ नहीं
मिल पाता है. इसके अलावा, महाराष्ट्र
में आंगनवाड़ी केंद्रों के अपर्याप्त संख्या के कारण कुपोषण और एनीमिया जैसी गंभीर
समस्या से निपटने में कामयाबी नहीं मिल पा रही है.

एमपीजे ने आंगनवाड़ी पर  1 जुलाई से 31
जुलाई तक राज्य व्यापी जन जागृति अभियान चला कर आंगनवाड़ी केंद्रों के बारे में
जनता को जागृत करने का प्रयास किया. इसके अलावा एमपीजे ने राज्य सरकार से आबादी के
मुताबिक आंगनवाड़ी केंद्र स्थापित करने और इसकी सेवाओं तक सभी लोगों की पहुँच
सुनिश्चित करने की मांग की है. इसके साथ ही, किशोरियों को नियमित रूप से पूरक पोषण प्रदान करने की
व्यवस्था करने का भी आग्रह किया है.

MPJ का पंद्रह दिवसीय राजयव्यपी “रूग्णांचे हक्क अभियान”  मरीज़ों के अधिकार के चार्टर को पूरी तरह लागू करने और स्वास्थ्य संस्थानों द्वारा इसके पालन को सुनिश्चित करने हेतु अपनी मांग को लेकर सम्पन्न हो गया। अभियान के अन्तिम चरण में MPJ  ने विभिन्न ज़िलों में ज़िलाधिकारी के कार्यालय के समक्ष धरना-प्रदर्शन का आयोजन किया तथा ज़िलाधिकारी के माध्यम से माननीय आरोग्य मंत्री को मेमोरेंडम सौंप कर उनसे जनहित में इन मांगों को अविलम्ब पूरा करने का अनुरोध किया. 

प्रेस कांफ्रेंस आयोजित कर के मीडिया द्वारा सरकार तक बात पहुँचाने की कोशिश की गई. साथ ही MPJ ने इस बात की घोषणा की कि, संविधान के अनुसार “स्वास्थ्य सभी नागरिकों का मौलिक अधिकार है”, किन्तु ये अधिकार हमें नहीं मिल रहा है. इसलिए अपने इस अधिकार को पाने के लिए MPJ आंदोलन करेगी.
